English Language Learners and Standardized Testing in Vermont ...

English language learners in Vermont participate in two types of large-scale, high stakes assessments each year. Like all students, ELLs participate in annual standardized content assessments that measure students? attainment of academic content standards. In addition, ELLs participate in an annual standardized assessment that measures their attainment of English language proficiency standards. States administer both kinds of assessments as required by the federal education funding law, No Child Left Behind, passed in 2002.

To measure achievement in the content areas, ELLs in grades 3-8 and 11 are assessed in math, reading, writing, and science with the NECAP, the standardized content assessment given in four New England states. Only students in the US less than one year are exempt from participating in the reading and writing tests. Results from the NECAP tests are used to determine if all students in a school or district have made the expected progress in the content area. Scores for students identified as English language learners are included in the individual school and district reports and are also disaggregated for reporting on the ELL subgroup when there are at least 40 ELLs in a school or district.

To measure achievement in learning English, ELLs in grades K-12 are assessed with the ACCESS for ELLs test, a standardized language assessment developed by the WIDA Consortium and given in 27 states in the US. All ELLs participate in the ACCESS for ELLs test. Results from the test are used for two purposes: to determine progress in learning English and to determine eligibility for ELL services. In Vermont, students who receive a composite score of less than 5.0 and scores of less than 4.0 on the reading and writing subtests are considered limited English proficient and are eligible for ELL services. These eligibility guidelines are set by the state of Vermont as required by the federal government.

While the intent of the NCLB law is to hold all students to high standards, many educators and researchers have concerns about assessing English language learners, specifically whether assessments in English can accurately measure students? content knowledge (Kopriva, 2000). English language learners typically score less well on standardized assessments than their English only peers (Abedi & Dietel, 2004). Researchers find that language proficiency is related to academic achievement, i.e., as language difficulty of test items increases, the gap between the performance of ELLs and non-ELLs widens (Abedi, Leon, & Mirocha, 2003). Because language proficiency is related to academic achievement as measured by standardized assessments, researchers question the validity of scores for English language learners; with language as a confounding factor, the scores may not accurately reflect what the student knows or can do (Abedi, 2006).

Consequently, researchers have focused on determining whether test accommodations may reduce the impact of language background on assessment. While most test accommodations are intended to support students with disabilities, some accommodations do provide either direct or indirect linguistic support which may help ELLs (Center for Equity and Excellence in Education, 2005). While not an accommodation, linguistic modification, i.e., simplifying the language of a test item, has been found to help ELLs perform better (Abedi, Courtney, & Leon, 2003). Determining how the language of a test item impacts scores has led to further research on academic language: how it is conceptualized, taught, and assessed (Bailey, 2007).

To conclude, it is well established that language background or language proficiency is related to academic achievement. While ELL students will continue to participate in standardized content assessments, as required by law, the results of these assessments may not accurately reflect what students know and can do. Educators must consider the assessment results of ELL students in light of their language background. ELL students will continue to participate in standardized English language proficiency testing, as well.

George Zimmerman's lawyers said they saw "clear support for a strong claim of self-defense" after prosecutors released much of their evidence in the case.

Zimmerman, 28, has pleaded not guilty to second-degree murder in the Feb. 26 shooting death of Martin in the central?Florida?of Sanford. He claims he shot the unarmed 17-year-old in self defense while acting as a neighborhood watch volunteer.

Florida's "Stand Your Ground" law allows people to use deadly force when they fear great bodily harm or death. Supporters of the law, which was enacted in 2005, argue it is intended to serve as a deterrent to violent crime, but critics charge it encourages vigilante justice.

In a hearing under "Stand Your Ground," a judge, not a jury, determines whether evidence meets criteria laid out in the law, said?David Weinstein, a former?Florida?state and federal prosecutor now in private practice in Miami.

If the judge rules in Zimmerman's favor, he would be granted immunity from prosecution in Martin's death.

"If Zimmerman?wins the hearing, it's case over," said Weinstein.

On the other hand, if the case goes forward to a full-blown trial, the hearing would offer the prosecution a good look at the defense strategy, he added.

"This is your shot. You lay it all out," said Weinstein.

Lawyers for Zimmerman?said it would take several months to prepare for the hearing, which they expect to focus on whether Zimmerman?"reasonably believed that his use of his weapon was necessary to prevent bodily harm to himself."

Confrontation in Street

Zimmerman?shot and killed Martin during a confrontation in a gated community. Martin was walking back from a store when Zimmerman?called a 911 dispatcher and said the teen looked suspicious.

Zimmerman?said he shot Martin after Martin attacked him and repeatedly slammed his head to the ground. Citing the self-defense law, police initially declined to arrest Zimmerman?for several weeks after the shooting.

Minutes before he was killed, Martin spoke with a girlfriend on his cellphone. That conversation may prove to be crucial testimony in the hearing, said?Charles Rose, a professor at the?Stetson University College of Law.

"The hearing may very well rotate around what?Trayvon Martin?did or did not say while he was on the phone right before the altercation," said Rose.

Ben Crump, a lawyer for Martin's family, said he expects the case will eventually go to trial.

"A grown man cannot profile and pursue an unarmed child, shoot him in the heart and then claim 'Stand Your Ground,'" he said in statement. "We believe that the killer's motion will be denied."

On Thursday, prosecutors released new evidence in the case, including Zimmerman's college records. But they later recalled some of the documents after realizing they included an indistinct photo of Martin's dead body, which is protected under?Florida's privacy laws.

Zimmerman?is free on a $1 million bond and living in an undisclosed safe house near Sanford.

Adoption of babies in UK down by 20 per cent in the last year ...

The number of babies being adopted in Britain has plunged by 20 per cent in the last year, Government figures have shown.
Only 76 children under one were permanently taken on by UK families in 2011, down from 95 in 2010. David Cameron is trying to speed up the process because many children are stuck in care for long periods from birth, despite prospective parents being desperate to adopt them.

At the moment people have to wait on average two and a half years to have their application processed but the Prime Minister wants this down to three months.

Adoptions also increased in Scotland between 2010 and 2011 by 6 per cent, from 466 in 2010 to 494 in 2011.

Mission: David Cameron has said he is determined to speed up the adoption process, which currently takes more than two years In a reverse of last year?s figures, 49 per cent of children adopted in 2011 were male and 51 per cent were female. Since 1998, the number of male and female adoptions has been fairly even, the ONS said.

Nearly two-thirds - 62 per cent - of children adopted in Britain last year were aged between one and four. The proportion of adopted children aged one to four has steadily increased since 1998. Last year?s figure is almost double the proportion in 1998.

Meanwhile, the proportions of adoptions of other age groups has decreased. For children aged between five and nine, the proportion has decreased from more than a third in 1998 to just under a quarter in 2011. The percentage of children between 10 and 14 being adopted has more than halved from over one in five in 1998 to one in 10 in 2011. The percentage of adopted children aged 15 to 17 has decreased to 2 per cent, from 5 per cent in 1998.

Under Mr Cameron's plans youngsters will be able to move in with their possible future permanent families before lengthy legal procedures are finalised, the Prime Minister said last month.

He hopes the Fostering For Adoption scheme will give children a better start in life by ensuring they have a stable home as quickly as possible. Under the plans, men and women who have been cleared as adopters can become a child?s foster parent until they are legally allowed to adopt them. Now, local authorities generally wait until court orders are made before beginning their search for a permanent home.

The move will not pre-empt any legal ruling, meaning the youngsters could be returned to their birth parents or other carers. But the Government hopes it will mean the interests of the children are put first.

Cyberplex Reports Second Quarter 2012 Results | Nearshore Journal

TORONTO, ONTARIO ? (Marketwire) ? 08/09/12 ? Cyberplex Inc. (TSX: CX) a leader in audience targeting and customer acquisition strategies today announced its financial results for the second quarter ended June 30, 2012. Total revenue from continuing operations for the quarter was $3.9 million, an increase from the $2.8 million recorded in the same quarter of 2011, and adjusted EBITDA loss for the quarter was approximately $699,000 as compared to a loss of $822,000 in the same period of 2011. Net income for the quarter was $5.2 million as compared to a net loss of $2.0 million for the same quarter of 2011. Included in net income for the quarter ended June 30, 2012 is $6.3 million of income from discontinued operations (See ?Discontinued Operations? below), primarily related to the gain on the sale of Tsavo Media (?Tsavo?). The loss from continuing operations for the period was $1.1 million compared to a loss of $822,000 in the same period a year ago.

Results for the Second Quarter ended June 30, 2012

  --  At June 30th the Company cash on hand of $6.2 million; --  The Company generated revenue of $3.9 million from continuing     operations, a 39% increase from the $2.8 million recorded in the     previous quarter; --  Adjusted EBITDA loss from continuing operations for the quarter was     $699,000, as compared to $822,000 in the same period of 2011.  

Discontinued operations:

On April 24, 2012, the Company sold Tsavo as part of a series of transactions valued at approximately $33 million. The Company reclassified the results of Tsavo to discontinued operations for financial reporting purposes, isolating the Tsavo operating results for the three and six month periods ended June 30, 2012 and 2011 from the remaining continuing operations of Cyberplex. Income for the quarter ended June 30 from discontinued operations of $6.3 million consisted of a gain on sale of Tsavo of $6.3 million and offset by a loss for the period of $25,000 from Tsavo. In connection with the sale, Jeffery Collins is expected to transition from his position as CFO of the Company on or about September 30, 2012.

Normal Course Issuer Bid:

On April 24, 2012, the Company announced a NCIB under which it could purchase up to 11,913,232 of its common shares, representing approximately 10% of the ?public float? of common shares, commencing on May 14, 2012 for a period of one year. As of the date of filing the Company has repurchased and cancelled 165,442 of its common shares under the NCIB.

Non-IFRS Financial Measures

This press release includes a discussion of ?Adjusted EBITDA,? which is a non-IFRS financial measure. The Company defines Adjusted EBITDA as net loss from operations before; (a) depreciation of property and equipment and amortization of intangible assets; (b) stock-based compensation expense, (c) restructuring and acquisition costs, (d) Impairments of goodwill and intangible assets and other items, net. Management uses Adjusted EBITDA as a measure of the Company?s operating performance because it provides information related to the Company?s ability to provide operating cash flows for acquisitions, capital expenditures and working capital requirements. Management strongly encourages investors to review the Company?s consolidated financial statements in their entirety and to not rely on any single financial measure.
